Definitions

Personal data” or “Data” means any information relating to an identified or identifiable natural person.

Processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means.

Data Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing.

Subcontractor” means the natural or legal person, public authority, agency or other body that processes Personal Data on behalf of the Data Controller.

In connection with the operation of its website, Société d’Exploitation des Ports du Détroit, SA, a company with a board of directors registered with the Boulogne-sur-Mer Trade and Companies Register under number 804 834 711 (hereinafter referred to as “SEPD”) and having its registered office at 285 AVENUE DU MERITE MARITIME, 62100 CALAIS, implements, as Data Controller, the processing of your personal data.

This information notice applies to processing carried out on the main website of the SEPD, accessible at: https://www.portboulognecalais.fr/ (hereinafter the “Website”).

2. What are the legal bases for the processing of your personal data and for what purposes is it collected?

As a reminder, the CNIL considers that when a candidate submits an unsolicited application but no position is available, the processing is carried out at the candidate’s initiative and that, by sending their application, the candidate consents to the storage of their data in a CV database.

3. Who has access to your Personal Data?

Your personal data is shared with the following individuals and organisations:

  • To SEPD employees who need to know this information in order to perform their duties, in particular employees responsible for monitoring the SEPD’s website and communications, as well as its quality department responsible for handling complaints and its human resources department responsible for processing job applications;
  • Our partners and suppliers acting as processors within the meaning of the applicable data protection regulations, in particular the provider of our cookie solution (namely Google Analytics) and our hosting provider IKOULA;
  • Port companies or other ports concerned by your complaint when it cannot be handled independently by the SEPD; 
  • Any administrative or judicial authority, our auditors, as well as qualified persons (lawyers, auditors, etc.) who request it or who need access to it in the course of their duties, for the purposes of any inspection or litigation.

 

4. From whom do we collect your Personal Data?

We collect your Personal Data directly from you, via the contact form, via your application, and via your visit to our Website.

 

5. Are your personal data transferred abroad?

Your personal data is not transferred outside the European Union, with the exception of data processed as part of the Google Analytics solution, which is transferred to the United States.

In the event that the SEPD uses service providers located outside the European Union and the European Economic Area (EEA: EU Member States, Iceland, Liechtenstein and Norway), it ensures that data transfers outside the EEA take place legally, using the transfer tools provided for in the data protection provisions and providing appropriate safeguards and protective measures. To this end, either the service providers are located in a country whose level of protection has been deemed adequate by the European Commission, including the United States under the conditions provided for in the Data Privacy Framework, or standard contractual clauses approved by the European Commission have been signed with these recipients.

 

6. How long do we retain your Personal Data?

Your personal data is stored by the SEPD in accordance with regulations on the protection of personal data.

More specifically:

  • The Personal Data we collect via the contact form (purpose no. 1) is retained for the duration of the request processing, then archived for the applicable statutory limitation period. 
  • The Personal Data we collect in connection with your unsolicited applications (purpose no. 2) is kept for the duration of the evaluation of your application, then archived for the applicable legal limitation period, and in particular for two (2) years in our CV database.

7. What are your rights regarding personal data?

As a data subject, you have the right to access, rectify and restrict your Personal Data, as well as the option to send us your instructions regarding the fate of your Personal Data in the event of your death. 

You also have the right to erasure and portability of your Personal Data, as well as the right to object to the Processing thereof.

Where you have consented to the Processing, you have the right to withdraw your consent at any time. 

Please note: to exercise your right to withdraw consent when Processing is based on consent in the context of purpose no. 3, you can also carry out the technical steps described in the Cookie Management section of this Policy. 

You also have the right to lodge a complaint with a supervisory authority such as the Commission Nationale de l’Informatique et des Libertés (CNIL) in the event of a breach of the applicable regulations on the protection of personal data, in particular European Regulation No. 2016-679 on General Data Protection (GDPR), in force since 25 May 2018.

9. Cookie management

Lifespan of cookies and collected information:

We apply the retention periods recommended by the CNIL. 

Your choice regarding the acceptance or refusal of Cookies subject to your consent is retained for a period of six (6) months from the date of your decision. After this period, we will ask you again for your consent to the use of these Cookies.

“Technical” or “essential” Cookies are retained for the period necessary for the provision and proper operation of the service. 

The lifetime of purely statistical audience measurement cookies (excluding Google Analytics) is limited to thirteen (13) months.

The retention period for information collected from cookies does not exceed twenty-five (25) months.
